Update for FMCSA Employers Performing Pre-Employment Drug and Alcohol Program Violation Inquiries

Effective January 6, 2023, FMCSA employers will no longer have to perform previous employer verifications by conducting manual inquires as to possible Drug and Alcohol violations. The DOT Clearinghouse should be used for all potential new hires that worked previously under FMCSA modal as noted by 49 CFR Part 391.23(e).

This change was initiated since the DOT Clearinghouse will have three (3) consecutive years' worth of violation data for Motor Carriers to search for records that may exist for drivers on January 6, 2023. Keep in mind if a driver is applying for a position under FMCSA but worked for a different DOT modal, such as the Federal Transit Administration or Federal Aviation Administration, the manual verification process is still in effect.
