12/2 Update for FMCSA Employers Performing Pre-Employment Drug and Alcohol Program Violation Inquiries

Effective January 6, 2023, the Department of Transportation (DOT) Clearinghouse will have three (3) consecutive years' worth of data to search for drug and alcohol violations belonging to Federal Motor Carrier Safety Administration (FMCSA) drivers.


Under 49 CFR 391.23(e), FMCSA-regulated motor carrier employers must query the DOT Clearinghouse for the previous three years of drug and alcohol violations for drivers in safety-sensitive positions. However, Truescreen has confirmed with DOT that drug and alcohol related driving history can still be collected by performing employment verification queries after January 6, 2023. This service is performed by requesting the previous work history and DOT Accident History via direct correspondence with the subject's previous employers.

At the moment, this will not change the current process that Truescreen is following. We will continue to contact previous employers for both DOT Accident History and drug and alcohol violations. If a driver is applying for a position under FMCSA but worked for a different DOT modal, such as the Federal Transit Administration or Federal Aviation Administration, the manual verification process will ensure verification of violation history under all possible modalities.
