According to the OMB’s Notice of Action, the USCIS will continue to accept the current (expired) version of the form for another 150 days – meaning employers can continue using these forms until Jan. 21, 2017. The new Form I-9 will have an expiration date of Aug. 31, 2019.
Now more than ever, employers will want to ensure that they are using the proper version of the Form I-9 as the U.S. Department of Justice recently increased penalties for violations related to the form nearly two-fold.
