SB 731 was approved by the Governor on September, 29 2022. The new California law will automatically seal records for non-violent, non-sex offender related offenses for certain California citizens. This means that expunged records will not be available to most employers. Certain select institutions would still have access to these records including schools, the state justice department, law enforcement and courts.
The bill would predominantly apply to individuals convicted of a felony; however, there are a few conditions. Some eligibility requirements include that:
- The conviction occurred after January 1, 2005;
- The sentence, probation, or parole was completed as required; and
- The individual was not convicted of any new felony convictions for four years.
