The bill was signed into law by Mayor Bill DeBlasio on Wednesday, May 6, and will bar employers from procuring consumer credit reports or credit score information on current or prospective employees and will also prohibit employers from obtaining additional credit history information directly from applicants or employees, including information concerning “(i) prior bankruptcies, judgments, or liens, or (ii) number of credit accounts, late or missed payments, charged-off debts, items in collections, credit limit, or prior credit report inquiries.”
Also included in the bill are over a dozen examples of positions which are exempt under the law including public safety positions or jobs requiring bonding under federal, state or city law.
10 states have already banned the use of credit checks in hiring and with the signing of this bill New York City joins Chicago and Madison (WI) as cities that have also banned the practice.
