The new closing date for submission of comments is extended to April 29, 2022.
The original comment period for the proposal would have closed March 30, 2022. However, DOT stakeholders have expressed concern that the closing date does not provide sufficient time to coordinate with their respective members. In order to allow sufficient time to comment for all interested parties the new date has been established.
The proposal follows the Department of Health and Human Services' 2019 rule that allowed federal executive branch agencies to use oral fluid specimens as part of the drug testing. Although the rule went into effect on Jan. 1, 2020, each agency is required to go through its own rulemaking process.
