Revised Michigan Supreme Court Order Aims to Ease Difficulties Completing Criminal Searches

A new registration process within MCR 1.109 will allow for date of birth reporting from the courts, making Michigan county criminal searches quicker for authorized parties.


As Truescreen previously reported, Michigan county courts recently implemented a process whereby date of birth was redacted from court records. This ruling has increased the turnaround time in Michigan county court searches due to difficulty confirming positive matches without the crucial date of birth confirmation of named parties in a record.

A recent Michigan Supreme Court order has updated MCR 1.109 and implements a new process that will allow authorized parties to obtain the date of birth in a court record for purposes of verifying identity. The State Court Administrative Office ("SCAO") will maintain a registry of authorized individuals who are permitted to obtain date of birth verification in court documents, without presenting a stipulation to the court.

As the individual courts in Michigan update to this protocol, we expect to see a quicker turnaround time with Michigan county criminal searches.
