Requirements Reminder Regarding Employment Eligibility Verifications for Form I-9 Surrounding COVID-19

The Department of Homeland Security (DHS) is reminding all employers that there are no exceptions currently in place regarding the verification requirements associated with Form I-9 documentation.


Concerns surrounding Coronavirus Disease 2019 (COVID-19) have triggered certain actions by the government; however, no changes are being implemented at this time for in-person verification of identity and employment eligibility documentation for Form I-9.

Section 4.0 of M-274 regarding the completion of Form I-9, Section 2 states that the employee must present to the employer (or authorized representative) an original document or documents that indicate their identity and employment authorization within three business days of the individual's employment commencement date.

Furthermore, the terms of the verification mandate that while in the physical presence of the employee, the employer (or authorized representative) examine the documents with the employee. The employee must also present the original identification documents to the employer (or authorized representative) in order for the employer to determine if it reasonably appears to be authentic and related to the present employee. Utilizing a webcam to review or examine required documentation is not a permissible option.
