Effective November 18, 2024, drivers with a "prohibited" status in the Federal Motor Carrier Safety Administration's (FMCSA's) Drug and Alcohol Clearinghouse will be denied or lose their State-issued commercial driving privileges.
If an FMCSA driver has violated 49 CFR Part 40 with a confirmed positive drug or alcohol test, or has refused to test, they will be excluded from performing safety-sensitive functions, including operating a Commercial Motor Vehicle (CMV). Drivers will only be allowed to resume their duties after fulfilling the Return to Duty process supervised by a Substance Abuse Professional (SAP).
Driver violation records are maintained in the DOT Clearinghouse for a period of five years from the date of violation determination, or until they successfully complete the follow-up testing plan, whichever is later.
