U.S. CONGRESS: New Fair Chance Act signed for FY 2020
Summary: On December 20, 2019, the National Defense Authorization Act (NDAA) for 2020, which also includes the Fair Chance Act, was signed by the President. The Act prohibits federal contractors that have openings for positions within the scope of federal contracts, as well as all federal agencies, from inquiring about or seeking criminal history information from an applicant until after a conditional job offer has been extended. The exceptions to this are positions related to law enforcement and national security duties, positions requiring access to classified information and positions that require a federal contractor or the federal government to obtain criminal history information before extending a conditional job offer.
