The sole update to this chart from the 2019 version is that the FMCSA has increased their rates from 25% to 50% random drug testing of the eligible employee pool. For additional information on that change, please see our previous News to Note: FMCSA Announces Random Testing Rate Increase for CDL Drivers.

Employers subject to more than one DOT Agency drug and alcohol testing rule may continue to combine covered employees into a single random selection pool. USCG covered employees may be combined with DOT covered employees in drug testing pools even though the USCG is now part of the Department of Homeland Security.
