On January 26, 2023, President Biden extended the program allowing certain Hong Kong residents in the United States under the Deferred Enforced Departure (DED) program to remain in the United States for two years. On February 3, USCIS extended the validity of certain Employment Authorization Documents (EADs) held by certain Hong Kong residents for two years pursuant to said declaration.
If an individual presents a Form I-766 bearing category code A-11 and an expiration date of 2/5/23, that EAD is now valid to establish identity and work authorization as a List A document until 2/5/25 and at that time reverification will be required.
Steps to Document Extended Work Authorization for Applicable Hong Kong EAD's
To document this on Form I-9, enter the 2/5/25 date as the expiration date of the card and add "EAD EXT 2/5/25" in the additional information field.
Importantly, if this is a new hire, the individual must update their work authorization expiration date in Section 1 of Form I-9 to reflect this extension.
If your existing employee needs reverification due to the 2/5/25 expiration date, you can simply update the expiration date in Section 2 of Form I-9 and add "EAD EXT 2/5/25" in the additional information field.
