Oregon Bill Prohibits Requiring Driver's License as a Condition of Employment

Effective January 1st 2022, Senate Bill 569 prohibits Oregon employers from asking for an employee's driver's license information - unless the ability to legally drive is an essential function of the job in question.


Oregon SB 569, available here in full, also prohibits employers from requiring a driver's license as a form of identification when an employee is able to present other identification documents deemed acceptable for use on Form I-9. Employees may still present a driver's license voluntarily to an employer as a form of identification.

Employers are encouraged to routinely review applicable employment law legislation to ensure they are not contributing to document abuse.
