| Summary: A federal court approved a $1.2 million settlement between a national retailer and nearly 40,000 class members. Lead plaintiffs claimed that they were improperly notified of credit checks being ran on them after they applied for jobs with the retailer because the online application they filled out hid the disclosure amid page after page of fine print, in violation of the FCRA's standalone requirement. The settlement will release the retailer from "all claims based on the failure to provide a proper disclosure ... in connection with an employment-related background check" under the FCRA. Lead plaintiffs will receive $5,000 each and their attorneys will receive $300,000. Members of the "disclosure class," consisting of roughly 37,000 members, will receive $20 under the settlement and the remaining 53 adverse action class members will receive an additional $150. |
