ENACTED LEGISLATION
MISSOURI: Voters approve medical marijuana amendment; silent on off-duty employment context
Summary: Missouri voters approved Amendment 2, the Medical Marijuana and Veteran Healthcare Services Initiative, on Nov. 6, 2018, amending the Missouri Constitution to allow the use of medical marijuana for any medical condition approved by a physician. It also allows for cultivating marijuana plants at home. Amendment 2 will take effect on Dec. 6, 2018 but will take several months before patients will be able to purchase medical marijuana.

Amendment 2 specifically states that it does not provide protections to employees who are under the influence of medical marijuana at work, but it is otherwise silent on whether employers can continue enforcing drug-free workplace policies.

COURT OPINIONS
U.S. DISTRICT COURT FOR THE SOUTHERN DISTRICT OF CALIFORNIA: Settlement approved in FCRA violation class action
Summary: A federal court approved a $1.2 million settlement between a national retailer and nearly 40,000 class members. Lead plaintiffs claimed that they were improperly notified of credit checks being ran on them after they applied for jobs with the retailer because the online application they filled out hid the disclosure amid page after page of fine print, in violation of the FCRA's standalone requirement. The settlement will release the retailer from "all claims based on the failure to provide a proper disclosure ... in connection with an employment-related background check" under the FCRA. Lead plaintiffs will receive $5,000 each and their attorneys will receive $300,000. Members of the "disclosure class," consisting of roughly 37,000 members, will receive $20 under the settlement and the remaining 53 adverse action class members will receive an additional $150.
Impact(s): FCRA compliance – for general legal review
