Class action suit for violations of FCRA settled with cannabis retailer
Summary: Plaintiff filed a class action suit against a cannabis retailer alleging violations of the FCRA. The plaintiff argued that the employer rescinded an offer of employment based on the plaintiff's background check results without providing an adverse action notice. The plaintiff further argued that the employer failed to provide a copy of the background check report and a summary of rights as required under the FCRA. The employer has not admitted any wrongdoing under the FCRA; however, the employer has agreed to pay $60,500 to settle the claims. The 100-member class includes applicants and employees who suffered from adverse employment action as a result of a background check obtained since September 2017, who were not provided notice, a summary or a copy of the report.
