New Form I-9 Changes Recap
As you may recall from our previous communication, the United States Citizenship and Immigration Services (USCIS) released a new version of Form I-9, which is mandatory to transition to no later than November 1, 2023. This new version introduces several changes aimed at improving the efficiency and accuracy of the employment verification process. Some of the notable changes include:
- Reduction of Sections 1 and 2 to a single sheet.
- Addition of two new supplement pages: one for Preparer/Translator information and another for Rehire/Reverification information.
- Replacement of the term "alien" with "noncitizen."
- Inclusion of a list of Acceptable Receipts and a link to information on employment authorization extensions.
- Addition of a checkbox to indicate if the Form I-9 was completed virtually.
In tandem with the updated Form I-9, USCIS has also released a revised version of the Form I-9 instructions, featuring a streamlined format and additional guidance for the use of the new checkbox.
Availability of New Form I-9 in Our System
We are pleased to announce that the new version of Form I-9 will be available in our system starting September 5th, 2023. This means all Forms I-9 completed on/after this date will be generated on the new version of the Form. As such, you will begin to see Supplements A or B appended to Forms I-9 where the initial verification was completed using a previous form, in accord with the regulation.
Important Dates to Remember
While employers are allowed to start using the new Form I-9 as of August 1, 2023, it is mandatory to transition to the new version no later than November 1, 2023.
