EEOC and FTC release new background check compliance guide

The joint publication, titled "Background Checks: What Employers Need to Know" offers guidance on employment screening practices as they relate to complying with both the FCRA and Title VII of the Civil Rights Act of 1964.

The publication provides guidance for employers in complying with the aforementioned federal laws during all phases of the background screening process: before the information is received from current or prospective employees, using the information received and disposing of the information.

In addition to the guidance, the two agencies also provide links to additional resource material regarding more specific areas of background screening, such as pre-employment medical inquiries, social media screening and more.
